TERMS OF SERVICE FOR C-TRACK

Welcome to C-Track. These Terms of Service ("Terms") govern your access to and use of the vehicle tracking, telematics, and diagnostics platform hosted at https://c-track.vortan.io (the "Service"), operated by Vortan / C-Track ("we," "our," or "us").

Please read these Terms carefully before using the Service. By registering an account, logging in, or using C-Track, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


1. SERVICES PROVIDED

C-Track is a software-as-a-service (SaaS) platform designed for fleet management, vehicle telematics tracking, and OBD2 diagnostics. The Service ingests, processes, and displays location data and engine diagnostic parameters received from tracking hardware (such as ESP32 devices or compatible cellular OBD2 dongles).


2. USER ACCOUNTS & REGISTRATION

A. Account Security
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain the confidentiality of your account credentials and passwords.
- Notify us immediately of any unauthorized use or security breach of your account.

B. Responsibility for Account Activity
You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your login information.


3. TELEMATICS HARDWARE & VEHICLE INSTALLATION

A. Hardware Responsibility
You are responsible for purchasing, configuring, and installing any physical tracking hardware (e.g., ESP32 telemetry devices) used in connection with the Service.

B. Safe Installation & Vehicle Operation
You agree that the installation of tracking devices in your vehicles will be conducted safely, in compliance with manufacturer guidelines, and in a manner that does not interfere with the vehicle's safe operation, controls, or safety systems (e.g., airbags, brakes). You assume all risks associated with the installation and use of physical devices in vehicles.


4. ACCEPTABLE USE POLICY

By using C-Track, you agree not to:
- Use the Service for any illegal, unauthorized, or surveillance purpose without the explicit consent of the vehicle owner and/or drivers.
- Track vehicles or individuals in violation of local privacy and surveillance laws.
- Reverse engineer, decompile, or attempt to extract the source code of the platform or its underlying firmware.
- Interfere with or disrupt the integrity or performance of the Service, including sending excessive, spam, or malformed MQTT/HTTP telemetry payloads designed to overload our servers.
- Share your account access or platform credentials with unauthorized third parties.


5. SYSTEM AVAILABILITY, CONNECTIVITY, & DISCLAIMERS

A. "As-Is" and "As-Available" Basis
The Service is provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

B. Network & GPS Dependency
You acknowledge that real-time tracking, OBD2 diagnostics, and notification dispatches depend on external factors outside our control, including GPS satellite availability, mobile network/cellular connectivity, internet routing, and MQTT broker uptime. We do not guarantee:
- That tracking will be 100% accurate, uninterrupted, or error-free.
- That SMS or email notifications will be delivered instantly or without delay during network outages.
- That AI-generated diagnostics suggestions will be correct or replace a professional mechanic's physical inspection.


6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Vortan / C-Track, its affiliates, directors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses.
- Costs associated with vehicle breakdowns, accidents, or diagnostic errors.
- Damages resulting from your access to, use of, or inability to access or use the Service.
- Any unauthorized access to or alteration of your transmissions or data.

Our total liability for any claim arising under these Terms shall not exceed the amount paid by you, if any, to use the Service.


7. INTELLECTUAL PROPERTY RIGHTS

We own and retain all rights, titles, and interests in and to C-Track, including all software, source code, designs, logos, graphics, database schemas, and intellectual property. Nothing in these Terms grants you any right or license to use our trademarks, brand names, or intellectual property without prior written consent.


8. SUSPENSION & TERMINATION

We reserve the right to suspend or terminate your account and restrict your access to all or part of the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the platform, or is otherwise illegal.


9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of our operating jurisdiction.


10. MODIFICATIONS TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
